Our services include but are not limited to:

We do not guarantee employment outcomes, specific salary increases, or career advancement as a result of using our Platform. Our services are educational in nature and designed to enhance your skills and knowledge in UI/UX design.

To access certain features of the Platform, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any losses caused by unauthorized use of your account.

You must be at least 16 years old to create an account. If you are under 18, you represent that you have obtained parental or guardian consent to use the Platform. We reserve the right to request verification of age at any time.

You may not create multiple accounts to circumvent any limitations or restrictions we may impose. We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

When using our Platform, you agree to comply with all applicable laws and regulations. You are solely responsible for your conduct and any content you submit, post, or display on the Platform.

The following activities are strictly prohibited:

• Violating any applicable laws, regulations, or third-party rights
• Sharing account credentials with unauthorized users
• Attempting to gain unauthorized access to other users' accounts or our systems
• Using automated tools, bots, or scripts to access the Platform
• Uploading or distributing malicious software, viruses, or harmful code
• Engaging in harassment, bullying, or discriminatory behavior

• Using the Platform for any commercial purposes without written consent

Violation of these conduct rules may result in suspension or termination of your account, removal of content, and potential legal action.

All content on the Platform, including but not limited to course materials, videos, text, graphics, logos, images, audio clips, and software, is owned by lomaravexintal Pty Ltd or our licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial educational purposes. This license does not include the right to:

• Reproduce, distribute, or publicly display our content
• Create derivative works or modifications of our materials
• Use our content for commercial purposes or financial gain
• Remove or alter copyright notices or proprietary markings
• Reverse engineer or attempt to extract source code

You retain ownership of any original content you create and submit to the Platform, but you grant us a worldwide, royalty-free license to use, display, and distribute such content in connection with operating the Platform.

Certain features and courses on the Platform require payment. All fees are quoted in Australian Dollars (AUD) unless otherwise specified. Payment must be made in full before accessing premium content or services.

We use secure third-party payment processors to handle transactions. By making a purchase, you agree to the terms and conditions of our payment processors. We do not store your complete payment information on our servers.

Refund Policy: We offer a 14-day refund period for most courses, starting from the date of purchase. To be eligible for a refund, you must not have completed more than 25% of the course content. Refunds are processed to the original payment method within 5-10 business days.

Subscription services may be cancelled at any time, but no prorated refunds are provided for unused portions of billing periods. Your access will continue until the end of the current billing cycle.

We reserve the right to change our pricing at any time. Price changes will not affect existing purchases but may apply to subscription renewals with 30 days' notice.

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our privacy practices as outlined in our Privacy Policy.

We comply with the Australian Privacy Principles under the Privacy Act 1988 (Cth) and implement appropriate technical and organizational measures to protect your personal data. We do not sell your personal information to third parties.

We do not warrant that the Platform will be error-free, secure, or available at all times. We make no representations about the accuracy, completeness, or timeliness of content on the Platform.

Your use of the Platform is at your own risk. We are not responsible for any damages to your computer system, mobile device, or data that may result from using the Platform.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, lomaravexintal PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, REGARDLESS OF THE THEORY OF LIABILITY.

Our total liability for any claims arising from or relating to these Terms or the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or AUD 0, whichever is greater.

These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

You acknowledge that the fees we charge reflect this allocation of risk and that we would not provide the Platform at these prices without these limitations.

You agree to indemnify, defend, and hold harmless lomaravexintal Pty Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your conduct in connection with the Platform
• Any content you submit or display on the Platform

This indemnification obligation will survive termination of these Terms and your use of the Platform.

You may terminate your account at any time by contacting us or using account deletion features within the Platform. Upon termination, your right to access and use the Platform will immediately cease.

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason, including but not limited to breach of these Terms, suspected fraudulent activity, or extended periods of inactivity.

Upon termination, provisions that by their nature should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

If your account is terminated for violation of these Terms, you may not create a new account without our written permission.

These Terms are governed by and construed in accordance with the laws of the Australian Capital Territory, Australia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.

Before initiating any legal proceedings, you agree to first attempt to resolve disputes through good faith negotiations. If informal resolution is unsuccessful after 30 days, disputes may be submitted to binding arbitration under the Australian Centre for International Commercial Arbitration (ACICA) rules.

Class action lawsuits and jury trials are waived for any disputes related to these Terms or the Platform. This provision does not limit your right to pursue claims in small claims court for matters within its jurisdiction.

These Terms constitute the entire agreement between you and lomaravexintal Pty Ltd regarding the Platform and supersede all prior agreements and understandings. If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. No waiver of any provision will be deemed a further or continuing waiver of such provision or any other provision.

You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms without restriction. These Terms are binding upon your heirs, successors, and permitted assigns.

Section headings are for convenience only and do not affect the interpretation of these Terms. Any ambiguities in these Terms shall not be construed against the drafting party.
